Personal Injury &
Parties who have suffered personal injuries, damage or loss as a consequence of the negligence of a party owing a duty of care, are entitled by law to monetary compensation for the non-pecuniary loss suffered. Such losses include, recovery for pain and suffering, loss of amenity and loss of earning capacity. The compensation is in the form of ‘damages’; the court will award a conventional sum of money to persons who have suffered injury which cannot be quantified into monetary terms.
In personal injuries cases which result in the death of the victim, the dependants of the victim are entitled to recover compensation under the Compensation for Injuries Act, Chap. 8:05.
Notably, a party seeking recovery in these claims may also recover compensation for pecuniary losses consequent to the injuries sustained such as expenses for medical care and medication and damage to property among others provided that they can be specifically pleaded and proved by documents.
