In Trinidad and Tobago, every individual has a right to access healthcare irrespective of race, colour, religion, or sex.

The Ministry of Health is the central authority which governs public health. This body has established some important rights as set out under the Patient’s Charter of rights. These include; the right to access to health care, the right to privacy and confidentiality in respect of medical ailments and care, right of access of patient to medical records and right to participation in planning treatment. Patients are therefore entitled to seek redress for infringement of their rights and compensation for the same where their rights have been breached by a public or private authority.

To determine whether or not there are any grounds to bring a claim and the relief that one is entitled to, the facts of the case must be assessed in light of the law.
