The framework of the judicial system contains a hierarchy such that appeals can be made to a superior court of record to overturn a decision of a lower court. Hence, an aggrieved party is entitled to appeal a decision made by a lower court if he has sufficient ground(s) to make an appeal. In both civil and criminal cases, persons can appeal decisions made in the High Court or the Magistrate’s Court in the Court of Appeal and the same can be further appealed if leave is granted to appeal to the Privy Council, the highest appellate Court in this jurisdiction.
The legislation to note is the Supreme Court of Judicature Act Chap. 4:01.
